We Are BeWell, LLC ("BeWell," "we," "us," or "our") operates this store and website at wearebewell.com, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a curated shopping experience (the "Services"). BeWell is powered by Shopify, which enables us to provide the Services to you. This Privacy Policy describes how we collect, use, and disclose your personal information when you visit, use, or make a purchase or other transaction using the Services, sign up for our emails or text messages, or otherwise communicate with us. Payment card information is collected through our secure checkout and processed by Shopify and our payment processors.
  • Account information including your username, password, security questions, preferences and settings.
  • Transaction information including the items you view, put in your cart, add to your wishlist, or purchase, return, exchange or cancel and your past transactions.
  • Communications with us including the information you include in communications with us, for example, when sending a customer support inquiry.
  • Text messaging information including your mobile phone number, your text message opt-in consent (such as the date, time and method of consent), and your interactions with our text messages.
  • Content you submit including product reviews, photos and videos you submit to us, donation program applications, and affiliate, ambassador or wholesale applications.
  • Health-related information you choose to share as described in the "Health-Related Information" section below.

Text Messaging (SMS/MMS)

If you opt in to receive text messages from BeWell, we collect your mobile phone number, your opt-in consent, and information about your interactions with our messages. We may also connect this with other information we hold about you, such as your purchase history and browsing activity on the Services. We use this information to send you the text messages you signed up for, which may include order and shipping updates, customer service messages, and marketing or promotional messages, and to tailor those messages to you.

We will not share your mobile information or opt-in consent with third parties or affiliates for marketing or promotional purposes. All other categories, such as text messaging originator opt-in data and consent, will not be shared with third parties. This does not include the service providers that help us operate our text messaging program (such as our messaging platform, Klaviyo, and wireless carriers), which process this information only on our behalf to deliver our messages.

Consent to receive marketing text messages is not a condition of any purchase. Message frequency varies. Message and data rates may apply. You can opt out at any time by replying STOP to any message, and reply HELP for help. You can also contact us using the details in the "Contact" section below. Carriers are not liable for delayed or undelivered messages.

Health-Related Information

Our products are designed for people managing medical treatments and chronic conditions. Some information you share with us, such as the products you buy, notes you include with an order or support request, answers to product-finder questions, reviews, content submissions, or donation program applications, may reveal or relate to a health condition or treatment. We collect and use this information only to provide the Services you request, fulfill your orders, respond to you, and administer the programs you apply to. We do not sell health-related information, and we do not use it for targeted advertising without your consent where consent is required by law. BeWell is a retailer, not a health care provider, and is not a "covered entity" under HIPAA. Please share only the information you are comfortable sharing. How We Disclose Personal Information

In certain circumstances, we may disclose your personal information to third parties for legitimate purposes subject to this Privacy Policy. Such circumstances may include:

  • With Shopify, vendors and other third parties who perform services on our behalf (e.g. IT management, payment processing, data analytics, email and text message delivery, customer reviews, customer support, cloud storage, fulfillment and shipping). We use Google Analytics to help us understand how our customers use the Services; you can read more in Google's Privacy Policy, and you can opt out using the Google Analytics opt-out browser add-on. We use Klaviyo to send our emails and text messages.
  • With business and marketing partners to provide marketing services and advertise to you. For example, we use Shopify to support personalized advertising with third-party services based on your online activity with different merchants and websites. Our business and marketing partners will use your information in accordance with their own privacy notices. Depending on where you reside, you may have a right to direct us not to share information about you to show you targeted advertisements and marketing based on your online activity with different merchants and websites. This does not apply to your mobile information or text message opt-in consent, which is never shared for marketing purposes as described in the "Text Messaging (SMS/MMS)" section above.
  • When you direct, request us or otherwise consent to our disclosure of certain information to third parties, such as to ship you products, to process an HSA/FSA payment through our payment partner, or through your use of social media widgets or login integrations.
  • With our affiliates or otherwise within our corporate group.

The Services are hosted by Shopify, which collects and processes personal information about your access to and use of the Services in order to provide and improve the Services for you. Children's Data

The Services are not intended to be used by children, and we do not knowingly collect any personal information about children under the age of majority in your jurisdiction. Our youth products are intended to be purchased by a parent, guardian or other adult.
